TST determina manutenção de 90% de atividade em caso de greve dos aeronautas

Decisão em caráter liminar (provisório) é da ministra Maria Cristina Peduzzi. O Tribunal Superior do Trabalho (TST) determinou, nesta sexta-feira (16), a manutenção de 90% dos aeronautas em serviço no caso de greve da categoria. A decisão é uma resposta à ação judicial do Sindicato Nacional das Empresas Aeroviárias (Snea) contra o Sindicato Nacional dos Aeronautas (SNA). O Snea argumentou, na ação, que a atividade exercida pelas empresas aéreas é essencial, nos termos da Lei de Greve. Segundo as empresas aéreas, a categoria, “de forma surpreendente”, anunciou uma paralisação das 6h às 8h, em diversos aeroportos do país, a partir de segunda-feira (19), sem esgotar todas as vias de negociação. O que o sindicado pediu: o Snea pediu declaração da abusividade da greve e a determinação de manutenção de 100% do efetivo de aeronautas em atividade; O que a Justiça concedeu em tutela cautelar (antes do julgamento final do mérito): a juíza Maria Cristina Peduzzi não declarou a greve como abusiva, mas determinou a manutenção de 90% dos aeronautas em serviço enquanto durar a greve. Segundo a ministra Maria Cristina Peduzzi, não há como, em liminar e sem ouvir o sindicato dos trabalhadores, atribuir natureza política ao movimento, com a declaração de sua abusividade e determinação de retorno de todos os trabalhadores ao serviço. Contudo, para a ministra, há necessidade de garantia dos serviços. “A urgência da medida se configura pela própria essencialidade dos serviços, bem como pela constatação de que a futura greve tem aptidão para gerar graves impactos na sociedade, notadamente por ser aprovada em período de aumento da demanda no setor de transporte coletivo aéreo”, afirmou. Além da manutenção dos 90% de serviço, a ministra determinou que o SNA se abstenha de constranger, dificultar ou impedir o acesso de empregados ao trabalho e de promover qualquer interferência indevida, interdição ou bloqueio de vias ou serviços relacionados ao setor de transporte aéreo. A decisão prevê multa diária de R$ 200 mil em caso de descumprimento.
