Uma juíza dos Estados Unidos bloqueou, no domingo (20), a ação do governo Trump de exigir que Apple e Google removam o aplicativo de mensagens chinês WeChat para downloads.

A juíza Laurel Beeler, de San Francisco, afirmou em um despacho que os usuários do WeChat que entraram com uma ação judicial “mostraram sérias dúvidas quanto ao mérito da reclamação da Primeira Emenda”.

Sua decisão de 22 páginas acrescentou que as proibições “carregam substancialmente mais discurso do que o necessário para servir aos interesses significativos do governo na segurança nacional, especialmente dada a falta de canais substitutos para a comunicação”.

Na sexta-feira, o Departamento de Comércio dos EUA emitiu uma ordem citando motivos de segurança nacional para bloquear o aplicativo da Tencent. O Departamento de Justiça pediu à juíza Beeler que não suspendesse a determinação. A Tencent e o Departamento de Justiça não comentaram imediatamente.

A liminar preliminar de Beeler também bloqueou a ordem do Departamento de Comércio que teria barrado outras transações com o WeChat nos EUA, o que poderia ter reduzido drasticamente a usabilidade do site nos EUA. O Departamento de Comércio não comentou imediatamente.

O WeChat tinha uma média de 19 milhões de usuários ativos diariamente nos EUA, disse a empresa de análise Apptopia no início de agosto. É popular entre estudantes chineses, americanos que vivem na China e alguns americanos que têm relacionamentos pessoais ou de negócios na China.

Beeler escreveu que “certamente o interesse geral do governo pela segurança nacional é significativo. Mas neste aspecto - embora o governo tenha definido que as atividades da China levantam preocupações de segurança nacional significativas - ele apresentou escassas evidências de que a proibição do WeChat para todos os usuários dos EUA aborda essas preocupações”.
