O TikTok disse nesta segunda-feira (24) que não tem escolha a não ser processar o governo norte-americano por causa do decreto do presidente Donald Trump que proibiu transações nos Estados Unidos com o popular aplicativo de compartilhamento de vídeos.

Em seu blog, o TikTok disse discordar fortemente da posição da Casa Branca de que represente ameaça à segurança nacional.

Disse ainda que o governo ignorou seus “profundos esforços” para tratar de receios do governo e acusou Trump de politizar a disputa ao pedir a proibição do TikTok em 6 de agosto.

“Não consideramos processar o governo levianamente”, disse TikTok. “Mas com o decreto ameaçando proibir nossas operações nos Estados Unidos… simplesmente não temos escolha.”

Em meio à crescente desconfiança entre Washington e Pequim, Trump se queixou por semanas que o TikTok, da empresa chinesa de internet ByteDance, é uma ameaça à segurança nacional e poderia compartilhar informações sobre usuários com o governo chinês.

O decreto de 6 de agosto prevê o banimento de transações com o aplicativo após 45 dias. Trump emitiu outro decreto em 14 de agosto dando ao ByteDance 90 dias para vender as operações da TikTok nos EUA e quaisquer dados.

A ByteDance comprou o aplicativo de vídeo Musical.ly, de Xangai, numa transação de US$ 1 bilhão, em 2017, e o relançou como TikTok no ano seguinte.

Na publicação desta segunda, o TikTok disse que Trump violou direito constitucional ao banir a empresa sem aviso prévio e o acusou de fazer mau uso da lei que permite ao presidente regular o comércio internacional numa emergência nacional.

Em maio de 2019, Trump invocou essa lei para interromper os supostos esforços de empresas de telecomunicações estrangeiras para realizar espionagem econômica e industrial contra os EUA.

Mas o TikTok disse que o decreto de 6 de agosto não se apoia na emergência declarada por Trump um ano antes e que a empresa não fornece os tipos de tecnologia contemplados naquele momento.

A ByteDance negocia vender as operações da TikTok na América do Norte, Austrália e Nova Zelândia para empresas como Microsoft e Oracle. Os ativos podem valer de 25 bilhões a 30 bilhões de dólares, disseram pessoas a par do assunto.
