Alguns reguladores da União Europeia se opuseram à decisão preliminar da Irlanda em uma histórica investigação sobre privacidade do Twitter, disse o regulador líder nesta quinta-feira (20), iniciando um processo em que se buscará uma decisão da maioria.

O Twitter parecia prestes a se tornar a primeira grande empresa de tecnologia a enfrentar uma multa da Comissão de Proteção de Dados da Irlanda (DPC) sob as regras mais rígidas de proteção de dados da UE, após o país ter submetido a decisão a outros membros do bloco em maio.

De acordo com o regime “One Stop Shop” do Regulamento Geral de Proteção de Dados da UE (GDPR) introduzido em 2018, os reguladores podem impor multas de até 4% da receita global de uma empresa ou 20 milhões de euros, o que for maior.

A Irlanda é utilizada como sede europeia de várias empresas de tecnologia dos EUA, tornando-se o principal regulador da UE para empresas como Twitter, Facebook, Apple e Google.

Mas deve compartilhar sua decisão preliminar com todas as autoridades de supervisão (CSAs) do bloco e considerar seus pontos de vista no veredito final.

“Uma série de objeções foram levantadas pelos CSAs e o DPC iniciou um processo de consulta com eles”, disse Graham Doyle, vice-comissário do DPC, em comunicado.

Como uma série de objeções foram mantidas, o DPC encaminhou a questão para o Conselho Europeu de Proteção de Dados (EDPB), acrescentou.

O EDPB tem agora um mês para alcançar um consenso de pelo menos dois terços dos membros e, se isso falhar, mais um mês para obter a maioria absoluta. Se ainda não for possível chegar a um acordo, o presidente do conselho terá o poder do voto final.

A decisão sobre o Twitter está relacionada a um bug em seu aplicativo para dispositivos Android, no qual publicações protegidas de alguns usuários se tornaram públicas e se a empresa notificou o regulador sobre o problema em tempo hábil. O DPC tinha 20 outras investigações em andamento sobre grandes empresas de tecnologia no final de 2019.
