Pedido de vista adia julgamento sobre bloqueio do WhatsApp no STF

O plenário do STF (Supremo Tribunal Federal) adiou nesta quinta-feira (28) o julgamento de duas ações que discutem, respectivamente, a eventual suspensão do aplicativo de conversa WhatsApp e questionamentos a dispositivos do Marco Civil da Internet, após um pedido de vista do ministro Alexandre de Moraes.

Na véspera, a ministra Rosa Weber votou no sentido de que a disponibilização das comunicações de usuários de aplicativos na internet só deve ocorrer por ordem judicial para fins de investigação criminal.

Nesta quinta, o ministro Edson Fachin acompanhou o voto da colega, com algumas divergências, e fez uma série de ponderações. “A criptografia não autoriza o desvirtuamento deliberado de campanhas eleitorais, a disseminação de discurso de ódio e o envio indiscriminado de materiais ofensivos”, ressalvou.

Por ora, não há prazo para a retomada do julgamento, que foi interrompido após o pedido de vista de Moraes. O advogado Erico Carvalho, sócio da Advocacia Velloso, destacou como importante o voto de Fachin, que, segundo ele, reconhece que “os direitos digitais são direitos fundamentais”.

Ele citou que, para Fachin, ordens judiciais não podem determinar que o provedor de aplicativos modifique o seu sistema de criptografia — divergência para Rosa, que “aparentemente” havia autorizado ordens de acesso para fins de investigação criminal ou instrução processual penal.

O advogado destacou que, para Fachin, a ordem de suspensão somente pode ocorrer quando houver violação a direitos de privacidade dos usuários, e que isso só poderia ser determinado pela ANDP (Autoridade Nacional de Proteção de Dados) — instituição que ainda não foi criada.

“Por fim, o ministro Fachin diz que, no momento, o uso da criptografia não permite a adoção de medidas que a enfraqueçam. Todavia, eventual enfraquecimento ou quebra da criptografia poderia vir a ser exigido no futuro no caso de mudança do cenário. Ou seja, caso se comprove a imprescindibilidade de mecanismos de interceptação do conteúdo de mensagens ou a obsolescência da criptografia”, destacou o advogado.
